Meraas Holding and its subsidiaries and affiliated companies (referred to in this policy as "Meraas" "us" "we" or "our") are committed to endeavouring to protect and respect the privacy of your candidate’s personal data collected and supplied at (the “Website”). Personal data is information which allows your candidate to be identified, for example by his/her CV. We hold this personal data in a database.
This Website is for use by only by Recruitment Agencies licensed in the United Arab Emirates in accordance with Article 17 of Federal Law No.8 of 1980 who have previously entered into a Contingency Recruitment Agreement (CRA) with us. You will continue to comply with the terms of the CRA when using this Website.
Failure on your part to obtain and retain all such relevant licences and comply with all applicable laws will result in suspension of your use of our Website and may also result in the termination of the CRA.
You will be provided with the details of the vacancies that Meraas requires you to source candidates for. For the avoidance of doubt, you will only be permitted access on the Website to these vacancies. You will not be able to search and submit candidate information for any vacancy that has not been assigned to your Agency.
By using our Website and submitting the CV of your candidate, you confirm that you have your candidate’s express consent to this collection and use. You also agree that your candidate’s information and personal data you provide to us is in all respects true, accurate, current and complete. You are responsible for updating the personal data and for maintaining its confidentiality as well as the confidentiality of your user name and password. You are responsible for all uses of your user name and password, whether or not authorised by you. You agree to immediately notify us of any unauthorised use of your user name or password. If you fail to comply with these terms we may restrict your access to this Website and delete your candidate’s data, we may also terminate the CRA. You agree to defend, indemnify, and hold harmless Meraas from and against any claims, actions or demands resulting from your breach of this Policy or in relation to your submission of information to us under this Policy whatsoever.
Why we require your candidate’s personal information
When you use services provided on this Website you will be asked to provide personal data about your candidate in order to apply or register for jobs on their behalf at Meraas. We will store this information and hold it on computers or otherwise.
We will use their personal data in the following ways:
- To process the job applications
- To answer any queries which you submit on behalf of your candidate
- In any other way that we deem reasonably appropriate in relation to or in connection with the above uses, in our sole discretion
If at any time, any information or personal data relating to your candidate and provided by you to us is found to be false, or if you and/or your candidate are/is found to have deliberately misrepresented or omitted any relevant information, we may refuse to employ your candidate, or if your candidate has become employed by us, we may terminate your candidate’s employment immediately without notice or payment in lieu of notice subject to the law and the terms of the employment contract. Any fees owed to you under the CRA may be subject to a reduction and any fees already paid to you under the CRA may be required to be refunded to us. We may also suspend your use of our Website either temporarily or permanently and may terminate the CRA at our absolute discretion.
By using this Website, you and your candidate expressly consent to these uses.
If you or your candidate choose not to provide certain personal data that we request, you will still be able to visit our Website but you may be unable to access certain options on their behalf.
Information obtained by us is used only for the intended purposes stated. We will not share your candidate’s personal data for any purpose with third parties apart from our database manager and your candidate’s nominated referees, unless otherwise stated at the time of collection. If at any time we wish to use your candidate’s personal data in a manner substantially and materially different from that stated when it was collected, we will endeavour to notify you and ask you to obtain your candidate’s consent to use their personal data in this different manner. If you do not respond to us within 7 days of this notification by contacting us at email@example.com, then we shall be entitled to consider that your candidate has given his/her consent to this. No notification will be provided or consent sought if Meraas is compelled or required by applicable law, statute, regulation, ordinance, or court order to disclose your candidate’s personal data to any security organisations, Government agencies or similar third parties.
We reserve the right to change this Policy at any time. Any changes to the Policy will be published on our website and shall be deemed to be incorporated into this Policy at the date of publication.
Sensitive personal data
If you do provide your candidate’s sensitive personal data (such as information relating to his/her race or ethnic origin, political opinions or religious beliefs) to us for any reason, we are entitled to assume that you have obtained your candidate’s explicit consent for us to use that sensitive personal data in the ways described in this Policy or as described at the point when you disclosed that sensitive personal data.
Use of non-personal data
Meraas may use your candidate’s anonymous data in order to collate industry, marketing and employment statistics. It may also ask third parties to collate any such statistics on its behalf. By your use of this Website, we are entitled to assume that you have obtained your candidate’s consent to this collation by Meraas and any third party. The data is not personal as it does not identify your candidate. We also monitor IP addresses for security purposes, trend analysis, site administration, and broad demographic information gathering for aggregate use.
The IP address of the computer you use to access the Website is not linked to any candidate personal data you provide to us.
Submission of candidate CV, job applications and offers of employment
Please be aware that the submission of your candidate’s CV for vacancies assigned to you by Meraas do not guarantee that your candidate will be successful in obtaining an interview and ultimately employment with us. In addition we provide no guarantee of the continued availability of any particular vacancy advertised and will not be held responsible should a vacancy be filled at any time prior to the removal of that vacancy from the Website.
We will conduct background checks on candidates including verification of work history and education and reference checking in accordance with our internal policies and procedures. By submitting an application on behalf of your candidate, we are entitled to assume that you have obtained your candidate’s consent to these background checks being conducted and that you have already conducted all necessary checks on your candidate as required by the CRA.
In order to help us fulfil our obligations under UAE Labour Law, your candidate agrees to disclose any disability, medical condition or work-related injury which may affect his/her ability to perform the inherent requirements of any position, and/or pose a risk to his/her health and safety, and/or the health and safety of our employees.
In addition to the tests required for the UAE residence visa medical fitness certificate, we may require your candidate to undertake any further tests, medical examinations or reference checks as we deem appropriate subject to the law. In those circumstances any offer of employment will be subject to your candidate passing any such test, examination or check.
An offer of employment will not be deemed valid unless such offer is formally made in writing by an authorised officer of Meraas and will not be deemed to have been accepted until a copy of the written offer is signed by your candidate and provided to Meraas as confirmation of your candidate’s acceptance of the offer and conditions set out in the offer.
Information Security and Integrity
We will endeavour to use all reasonable efforts as we deem appropriate to protect your candidate’s personal data from loss, misuse, unauthorised access, disclosure, alteration and destruction.
If you have not used our Website for a continuous period of 6 months or shorter if we deem appropriate, we may elect to suspend your registration and archive your candidate’s personal data.
Deletion of your personal data
You can choose to remove your candidate’s personal data from our Website at any time by using the “Deactivation” option. Your candidate’s personal data will then be permanently deleted from our Website and you will not be able to apply on his/her behalf for any jobs we assign to you unless you re-register your candidate with the Website and re-submit his/her personal data.
If we have had communication with your candidate as part of our recruitment process, this information may be kept on our database for audit and legal purposes.
The Website may contain links to other websites. Please be aware that we are not responsible for the privacy practices of websites not operated by us. You are encouraged to read the privacy polices of any website you visit. This Policy applies solely to personal data in relation to your candidate provided to us by you or your candidate.
Cookies are pieces of information that are stored on your computer and which allow us to recognise you are a register user and monitor which parts of the Website you have visited. No secure information or personal data is contained in our cookies.
This Policy is governed by the laws of Dubai and the Federal laws of the United Arab Emirates. Jurisdiction for any claims arising under this Policy shall lie exclusively with the courts of Dubai.
